Legal Notice

1. General

All business relationships between the customer and Mountain Entertainment Event Agency, owner Peter Beierl, Bahnhofplatz 2, D-83471 Berchtesgaden (hereinafter referred to as the Agency), are governed exclusively by these General Terms and Conditions. Contradictory terms and conditions of the customer are only valid if expressly acknowledged in writing by the Agency. Deviations or additions to these terms require written form. Should any provision of these terms prove to be invalid, this does not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that most closely approximates its intent and purpose.

2. Conclusion of Contract

The basis of the business relationship is the individual event offer, detailing the agreed services and remuneration. Offers from the Agency are non-binding.

3. Scope of Event Services

3.1. The scope of contractual services is based on the written confirmation. Side agreements or changes require written form.

3.2. Any necessary changes or deviations after contract conclusion will be communicated promptly. If these do not significantly alter the service, the client has no right to cancellation. The Agency may adjust the event schedule in consultation with the client.

3.3. If the Agency enters into agreements with third parties for the event, these are made on behalf and with the authority of the client. This includes, in particular, venue rentals, catering contracts, and contracts with artists.

4. Event Service and Fees

4.1. The client provides a budget as outlined in the written cost estimate. Any budget overrun requires written approval.

4.2. Unless otherwise agreed, the Agency’s fee becomes due as each individual service is rendered.

4.3. The Agency may request advance payments and undertakes to use such funds carefully and in the client’s interest. Payments must be made within the agreed timeframes.

4.4. Cost estimates are non-binding.

5. Presentation

If no contract is awarded following a proposal, all content and documents remain the property of the Agency and must not be used in any form by the customer. Upon request, all materials must be returned.

6. Ownership and Copyright

6.1. All services provided by the Agency (e.g., ideas, event concepts) remain the property of the Agency, even in parts. By paying the fee, the client acquires the right to use them for the agreed purpose only, and only within Germany, for the duration of the contract.

6.2. Changes to the Agency's services by the client are only permitted with the Agency’s and, where applicable, the author’s written approval.

6.3. Any use of the Agency’s services beyond the original purpose and scope requires separate written consent and entails additional appropriate compensation.

7. Termination / Cancellation

7.1. The client may terminate the contract at any time, but must pay for services already rendered or agreed upon.

7.2. After signing the order confirmation, no free cancellation is possible. A cancellation up to 4 weeks before the event incurs a 50% fee; from 4 weeks before the event, 100% of the total cost is due.

7.3. There is no reduction in the fee for saved expenses.

7.4. The Agency has the right to extraordinary termination, particularly if payment is not made on time.

7.5. The same applies if agreed budget contributions are not paid despite reminders.

8. Liability

8.1. The Agency commits to careful planning and selection of service providers according to commercial diligence.

8.2. Liability is limited to the written terms. Claims not explicitly stated are excluded unless caused by gross negligence or intent.

8.3. Compensation is limited to the agreed fee, regardless of legal grounds.

8.4. The Agency may assign claims for damages against third parties to the client, who may pursue them independently.

8.5. The client agrees to obtain event liability insurance.

8.6. Force Majeure: If services cannot be rendered due to force majeure (e.g., transport accident, official orders), the Agency is not obliged to perform and may withdraw if the issue persists for more than 2 weeks. Legal rights of the customer remain unaffected.

9. Payment

9.1. Invoices are due immediately and must be paid within 7 days without deduction. Late payments will incur interest of 2% p.a. above the base rate.

9.2. Offsetting is only permitted with undisputed or legally established claims.

10. Warranty and Damages

10.1. Complaints must be submitted in writing within three working days. If justified, damages are limited to the fee amount.

10.2. Further claims are excluded unless due to gross negligence or intent.

12. Alternative Dispute Resolution

In accordance with EU Regulation 524/2013, consumers may use the EU online dispute resolution platform at http://ec.europa.eu/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable Law

Only German law applies to the relationship between the client and the Agency, including the formation and consequences of the contract.

14. Jurisdiction

Jurisdiction for all disputes arising directly or indirectly between the parties shall be Berchtesgaden. However, the Agency may also choose another competent court.

15. Side Agreements

15.1. Both parties agree to maintain strict confidentiality over all business-related information, even after contract termination.

15.2. If any provision of this contract is found to be legally invalid, the remaining provisions shall remain in effect.

15.3. Claims may only be assigned by the client with the prior written consent of the Agency. The client is informed that data will be stored as part of contract processing.

16. Image Rights / Copyright of Media Content

All images, graphics, and media content used on this website or in proposals, presentations, and events are copyrighted and are the property of Mountain Entertainment Event Agency, Peter Beierl, or are used under license from third parties.

Any use, reproduction, distribution, editing, public display, or other use – especially for commercial purposes – is prohibited without express written permission. This includes downloading, saving, or sharing on social media or other platforms.

Any violation constitutes an infringement of copyright and will be subject to legal action.
